A GROUNDBREAKING ACTION WAS STARTED AGAINST THE FEDERAL UNION IN THE COURTS OF RIO DE JANEIRO

The legal brought action mashed together the constitution and written law with the every day expectations of every brazilian citizen. The 1988 constitution assures the right to proper education, healthcare and public security to everyone. The seventh paragraph of article 144 also guarantees that these activities offered by the State must be efficient. Article 206 underlines that quality standard´s must be held high. The Constitutional amendment number 19/98, usually referred to as “administrative reform”, sets out the following principles: “the public administration (…) shall obey the principles of legality, impartiality, morality, transparency and efficiency”.

Bourguignon Corporate Law realized that these legal demands were not being respected. The Federal Union no longer guarantees quality education, health care and public security. The State is not efficient in its proposed activities. The Federal Union not only does not offer quality services anymore, but has also stopped monitoring the efficiency of city and state services.

Therefore, Samuel Bourguignon has started a groundbreaking legal action against the Federal Union for the lack of quality and efficiency in the public services they offer, that are guaranteed by the 1988 constitution. The States duty is not being fulfilled, and that directly affects each citizen that can no longer rely on public health care, instead to personally absorb high costs during difficult times, as well as having to pay for private education, so that their children can be successful in their future careers.


INBRE SETTLES PARTNERSHIP IN RIO WITH BOURGUIGNON

The Brazilian Institute of Corporate Recovey (InBRE), led by lawyer Nacir Sales, is a non-profit organization that focuses on the development of case studies of recovering companies. The institute’s goal is to promote the culture of corporate recovery.
